La interdicción de discriminación por razón de la identidad sexual encuentra su protección en el art. 14 CE y se desarrolla en el resto del ordenamiento; sin embargo no es la igualdad el único derecho fundamental que puede verse afectado por la identidad sexual de las personas. El significativo desarrollo normativo efectuado para lograr una plena integración de las personas transexuales no ha de hacer olvidar que se requiere un esfuerzo en el cultivo de la igualdad por parte de los poderes públicos y de los particulares para lograr la auténtica igualdad de este colectivo.

Interdiction of discrimination because of sexual identity is protected by art. 14 Spanish Constitution, and it was been developed by the rest of the legal order; nevertheless it is not equality the only fundamental right that can be affected because of sexual identity. The significant legal development allowing a complete integration of transsexual persons has not permitted us to forget that it is yet necessary a challenge to political powers and private in order to achieve a complete equality.
