El conflicto de intereses en el nombramiento del experto en reestructuración. (RI §427821)  

La Directiva sobre reestructuración e insolvencia incluye en su articulado la previsión, a fin de evitar conflictos de intereses, de que los deudores y acreedores tengan la posibilidad bien de oponerse a la selección o al nombramiento del administrador concursal, bien de solicitar la sustitución del administrador concursal. En este marco, se analiza el alcance de las normas del texto refundido de la Ley Concursal que regulan la oposición, impugnación y sustitución del experto en reestructuración.

The Restructuring Directive includes in its articles the provision, in order to avoid any conflict of interest, debtors and creditors have the opportunity to either object to the selection or appointment of a practitioner or request the replacement of the practitioner. In this framework, the scope of the rules of the Revised Text of the Bankruptcy Law regulate the opposition, challenge and replacement of the restructuring expert is analyzed.
