Alive and kicking-the first year of the insolvency harmonization proposal of the European Commission. (RI §427060)

Slightly more than one year has passed since the Commission presented its legislative proposal harmonising certain aspects of insolvency law. This proposal for a second insolvency directive is still being negotiated by the EU co-legislators, but the past year prompted numerous activities from different actors, both EU institutions and private or public stakeholders. After a summary of the objectives and the underlying problems the proposal addresses, this article takes stock of the views and comments of the various stakeholders. The assessment of the nearly fifty written contributions received on the proposal in the public feedback-period after its publication shows a positive reception both by trade and business participants and by the professionals concerned.
