Se estudian, desde el punto de vista de la historia social de la administración de justicia, los conflictos suscitados por causa de los nacimientos ilegítimos. Se verifica que dentro de la amplia tipología de filiaciones ilegítimas establecidas en el Derecho de la Edad Media y de la Edad Moderna, la que suscitó más controversias judiciales, fue la de los hijos naturales. Se da la circunstancia de que éstos eran los únicos ilegítimos con derechos reconocidos por las leyes, lo que prueba que el fenómeno de la ilegitimidad suscitaba compasión hacia los “hijos del pecado”, pero también bastante marginación y mucha tendencia en la familia a no respetarle sus derechos.

This article studies the social conflicts that arose around children born out of wedlock in the Modern Age. Around these boys there were many lawsuits at the time of distributing the inheritances. Natural children caused more lawsuits than other illegitimate children because they were the only illegitimate children to whom the law granted rights.
Illegitimate children were “children of sin”, they provoked compassion, but they were marginalized, and many relatives did not want to respect their rights, for which reason they had to go to the courts of justice.
