The legal treatment of hate speech and hate crime in Ireland and Spain: a comparative criminal law perspective - Rafael Valencia Candalija

El presente artículo trata de realizar un análisis comparativo entre las legislaciones penales de Irlanda y España en materia de discurso y delitos de odio. Para ello serán evaluadas las normas penales encargadas de otorgar cobertura jurídica al objeto de estudio indicado. En el caso irlandés, el proyecto de ley publicado en 2022 trata de responder a las sombras e interrogantes que sigue planteando la ley por la que se prohíbe la incitación al odio de 1989, tratando de encontrar el equilibrio entre la necesidad de conferir protección penal a las conductas incluidas entre los tipos delictivos mencionados y la conveniencia de apostar por preservar el derecho a la libertad de expresión. En lo que a España respecta, será analizada la regulación del artículo 510 del Código Penal, incluyendo las novedades introducidas por la última reforma operada en este sentido durante el mes de julio de 2022.

This article attempts to carry out a comparative analysis between the criminal legislation of Ireland and Spain in the field of hate speech and hate crime. In order to do so, the criminal laws in charge of providing legal coverage to the object of study will be evaluated. In the Irish case, the bill published in 2022 attempts to answer to the shadows and questions still posed by the Prohibition of incitement to Hatred Act 1989, trying to find a balance between the need to provide criminal protection for the conducts included in the aforementioned offences and the convenience of preserving the right to freedom of expression. As far as Spain is concerned, the regulation of Article 510 of the Penal Code will be analysed, including the new features introduced by the latest reform carried out in this regard in July 2022.
