Consideraciones en clave de género sobre la valoración del testimonio en delitos contra la libertad e indemnidad sexuales en atención a la jurisprudencia reciente del Tribunal Supremo. (RI §425729)

La significación social de la violencia sexual es generadora de una evidente inquietud que, entre otros reclamos, ha estimulado la reivindicación de medidas más enérgicas en el ámbito de la justicia penal. Eslóganes ampliamente difundidos como el #YoSíTeCreo han tenido la virtud de dar luz a situaciones ciertamente discriminatorias que en otro tiempo no habrían siquiera accedido al debate público. Ahora bien, entre los efectos más cuestionables, la traducción procesal de la consigna ha dado lugar a un cambio ciertamente problemático en la interpretación jurisprudencial de la declaración de la víctima. Cambio que, en esencia, redibuja la posición de ésta como testigo privilegiado (en base a su cercanía respecto a los hechos) y reconfigura el valor de su testimonio (percibido bajo el privilegio de la inmediación) con la justificación de la (pretendida) integración de la perspectiva de género. En este trabajo el lector encontrará un análisis de los desafíos derivados esta nueva línea jurisprudencial y una propuesta de lo que a nuestro juicio encaja mejor en la integración armónica con las garantías procesales de la perspectiva de género.

The social significance of sexual violence is leading to a noticeable awareness that, besides other claims, has prompted the request for more rigorous measures in the criminal justice context. Widely disseminated slogans such as #YoSíTeCreo have had the virtue of shedding light on certainly discriminatory situations that in another time would not even have had access to public debate. Now, among the most questionable effects, the procedural translation of the slogan has led to a certainly challenging shift in the jurisprudential interpretation of the victim's statement. This interpretation redefines the position of the victim as a privileged witness (based on her proximity to the facts) and reconfigures the value of her testimony (perceived with the privilege of immediacy) under the justification of an alleged integration of the gender perspective. In this paper readers will find an analysis of the new challenges arising from this emerging jurisprudential line and a proposal of what in our opinion best fits in the most harmonious integration with the procedural guarantees of the gender perspective.
