El Derecho Romano ha procurado siempre otorgar las necesarias medidas de protección para los sujetos más vulnerables de la sociedad. Entre estos sujetos pasaron a encontrarse los menores de veinticinco años, que se encontraron constantemente en situaciones desventajosas para sus intereses. A lo largo del tiempo, se fueron presentando distintas soluciones a este problema, en la forma de instrumentos procesales, medidas extraprocesales e instituciones de guarda.

Roman Law has always tried to provide the appropriate protective measures for the individuals considered most vulnerable in society. Amongst these individuals we can find thos below the age of twenty-five, who constantly found themselves in disadvantageous situations. With the passage of time, new solutions appeared, in the form of procedural instruments, extra-procedural measures, and guardianship institutions.
