Video surveillance in domestic work: special attention to -the possible?- installation of hidden cameras - Josune López Rodríguez

El presente trabajo tiene por objeto analizar el alcance de la facultad de control del empleador ejercida a través de cámaras de videovigilancia, en concreto, en el sector del trabajo doméstico. A tal fin, primero, se examinará, desde una perspectiva crítica, el actual marco normativo relativo al control de las personas trabajadoras mediante sistemas de videovigilancia, prestando especial atención al trabajo doméstico. A continuación, se estudiará si es posible instalar cámaras secretas en el domicilio objeto de la prestación de trabajo, para lo cual se tendrán en cuenta los últimos pronunciamientos más relevantes que los tribunales han dictado sobre la materia.

The purpose of this paper is to analyze the scope of the employer's power of control exercised through video surveillance cameras, specifically, in the domestic work sector. To this end, first, the current regulatory framework regarding the control of workers through video surveillance systems will be examined from a critical perspective, paying special attention to domestic work. Next, it will be studied whether it is possible to install secret cameras in the home where the work is done, for which the latest most relevant court’s rulings will be taken into account.
