Free and equal? On the foundational myths of the State and their hierarchical and exclusionary effects - Blanca Rodríguez Ruiz

Como otras formas de organización político-jurídica, el Estado descansa sobre un mito fundacional, el contrato social, sustentado por una igualdad y una libertad igualmente míticas. A diferencia de otros mitos fundacionales, el del Estado se basa en pretensiones de universalidad que descansan sobre construcciones esencializantes de la naturaleza humana, diseñadas a la imagen y semejanza de quienes se erigieron en firmantes de ese mítico contrato. Este artículo aspira a deconstruir la mitología estatal mostrando sus sesgos y las relaciones de poder que la sustentan y que se retroalimentan de ella. En su lugar propone asumir la paridad ciudadana y la autonomía relacional como principios normativos anclados en la lógica democrática. Pretende también mostrar en un breve recorrido crítico el nivel de compromiso que con ellos asume el orden constitucional español y su intérprete auténtico, el Tribunal Constitucional.

Like other legal and political orders, the State has its own foundational myth, i.e., the social contract, based on the also mythical ideas of equality and freedom. Unlike other foundational myths, however, the State’s aspires to have universal validity, as it rests on an essentialising construction of human nature, which is however designed to the image of those who projected themselves as the signers of that mythical contract. This article aims to deconstruct State mythology, to show its bias and the power relations that sustain it and are reinforced by it. It proposes that we turn instead to parity and relational autonomy, as normative principles coherent with the democratic principle. It also offers a brief overview of the extent to which these principles are embraced by the Spanish constitutional order and its interpreter, the Constitutional Court
