This paper analyses the different conceptions on human social organisations, focusing on the concept of people, and its relation to that of citizenship, as well as the role both of them have in the exercise of sovereignty and their recognised juridical capacity, taking the Roman distinction between populus and civis as a framework, together with contemporary iterations of those same concepts.
At the same time, we will review the paradigm shift in international Law about the people’s juridical capacity by itself, and the flexibility shown by the idea of citizenship from its inception.
