Actualmente la manifestación pública de expresiones ofensivas o provocadoras por parte de twiteros, titiriteros o raperos ha vuelto a poner encima de la mesa el debate sobre si este tipo de conductas deben ser perseguidas y castigadas con el código penal en mano, bajo la rúbrica de delitos de enaltecimiento y apología del terrorismo, por quedar englobadas en lo que se conoce como delitos de odio, o si por el contrario, estas conductas son una manifestación de la constitucionalmente reconocida libertad de expresión. En este estudio pretendemos analizar la importancia y la regulación de la libertad de expresión en nuestro ordenamiento jurídico, así como, la regulación en nuestra legislación penal del enaltecimiento terrorista, para poder dar respuesta a la pregunta que muchos se plantean de si tipificar estas conductas puede ser entendido como un instrumento de protección ante el discurso del odio o si es un mero mecanismo de represión a la libertad de expresión.

Currently the public manifestation of offensive or provocative expressions by twitterers, puppeteers or rappers has once again put on the table the debate on whether this type of conduct should be prosecuted and punished with the criminal code in hand, under the rubric of crimes of exaltation and apology of terrorism, because they are included in what is known as hate crimes, or if, on the contrary, these behaviors are a manifestation of the constitutionally recognized freedom of expression. In this study we intend to analyze the importance and regulation of freedom of expression in our legal system, as well as the regulation in our criminal legislation of terrorist exaltation, in order to answer the question that many are asking about whether typifying these behaviors can be understood as an instrument of protection against hate speech or if it is a mere mechanism of repression of freedom of expression.
