Criminological analysis of the intensive porcine sector and animal welfare: implications of the 2020 reform - Lorea Arenas García

La cabaña porcina española es la mayor de Europa y su crecimiento interanual no cesa desde la última década. Tan solo en 2019 se contabilizaron 31.246.000 animales. Es el cuarto país del mundo que más millones de toneladas de carne produce exportando gran parte de la misma a China. El sector ganadero, y en especial el porcino intensivo, obtiene beneficios económicos gracias a un sistema de explotación caracterizado por la presencia de macro granjas capaces de criar y sacrificar en poco espacio y tiempo a miles de ejemplares. Esta realidad es especialmente característica de las Comunidades Autónomas de Cataluña y Aragón, las cuales concentran a la mitad de la población porcina del país. Este sistema productivo intensivo conlleva grandes ganancias, pero también impactos negativos en el bienestar de los animales, la salud humana y el medio ambiente. En el caso del sector porcino esta situación ha dado lugar a principios de 2020 a su reforma integral, siendo el primer sector que ha adoptado esta nueva estrategia de regulación, aunando y coordinando en un texto, el Real Decreto 306/2020, de 11 de febrero, toda la normativa económica, comercial, de actividades profesionales y, sobre todo, ambiental y de bienestar animal. En este trabajo se pretende, empleando una revisión y análisis de fuentes secundarias de información, evaluar el statu quo del sector. A tal fin se analiza: la normativa vigente en materia de bienestar animal con especial atención a la reforma de 2020; la evolución del censo de ganado porcino determinando el número, tipo y capacidad productiva de las explotaciones porcinas; sus consecuencias en el bienestar animal de los cerdos; y el impacto ecológico de los purines porcinos. Los resultados más significativos ponen de manifiesto que la población porcina crece año tras año en instalaciones de tipo intensivo y de gran capacidad; que la actual reforma de 2020 es limitada al no ir más allá de la normativa vigente en materia de bienestar animal; que este último se ve comprometido justificándose prácticas que generan dolor y sufrimiento; y que la gran cantidad de deyecciones producidas contaminan la atmósfera y el medio terrestre y acuático, ocasionando efectos nocivos en la salud humana y en los animales.

The Spanish pig herd is the largest in Europe and its year-on-year growth has not stopped since the last decade. In 2019 alone, 31,246,000 animals were counted. It is also the fourth country in the world that produces more millions of tons of meat, exporting much of it to China. The livestock sector, especially the pig, obtains economic benefits thanks to an intensive exploitation system characterized by the presence of macro-farms capable of raising and sacrificing thousands of specimens in a short space and time. This reality is especially characteristic of the autonomous regions of Catalonia and Aragon, which account for half of the country's pig population. Such intensive production system entails great economic gains but it also has negative impacts on animal welfare, human health and the environment. In the case of the pig sector, this situation has led to its comprehensive reform at the beginning of 2020, being the first sector to adopt a new integrated regulatory strategy, combining and coordinating in one text, Royal Decree 306/2020, of February 11, the rules applicable to its economic, commercial and professional activities, as well as to its environmental conditions and animal welfare requirements. This work intends to evaluate the status quo of the sector up to that moment by reviewing and analyzing secondary sources of information. To this end, the following are analyzed: current regulations on animal welfare with special attention to the 2020 legislative reform; the evolution of the pig cattle census to determine the number, type, and productive capacity of pig farms; its consequences on the animal welfare of pigs; and the ecological impact of pig slurries. Our results show that the pig population has grown year after year in intensive and high-capacity facilities; that the recent 2020 comprehensive regulatory reform is limited as it does not go beyond the current regulations on animal welfare; that the latter is compromised by justifying practices that generate pain and suffering; and that the large amount of slurries produced pollutes the atmosphere, and the terrestrial and aquatic environment, causing harmful effects on human and animal health.
