Access to justice and digital transition: towards a justice open to citizens (A2J4all) - Aura Esther Vilalta Nicuesa

Resulta inaplazable el tránsito hacia la plena digitalización para lograr una justicia abierta, relacional, resiliente, eficiente, comprometida con las necesidades reales de las personas, en particular las que padecen algún grado de discapacidad o vulnerabilidad, y que aproveche todo el potencial de las herramientas de vanguardia, dentro del pleno respeto de los derechos fundamentales. La implantación del futuro espacio “Mi justicia electrónica” que la Comisión Europea demanda a todos los Estados Miembros como punto de entrada a los servicios de justicia de ámbito nacional en el Portal Europeo de e-Justicia es el punto de arranque del futuro modelo de justicia digital. Su impacto bidimensional - en acceso y proceso - plantea cuestiones de calado en orden a garantizar los principios y valores en juego. Este trabajo, de carácter necesariamente seminal, apunta ya algunas cuestiones problemáticas en sus dos esferas, identifica principios y valores a preservar y adelanta los retos más señalados que España debe arrostrar en los próximos años.

The transition towards a full digitization to achieve an open, relational, resilient, efficient justice that is committed to the real needs of people, particularly those with some degree of disability or vulnerability, and taking advantage of the full potential of cutting-edge technology within the full respect of fundamental rights, cannot be postponed. The implementation of the future space "My electronic justice" that the European Commission demands from all Member States as the entry point to national justice services in the European e-Justice Portal is the starting point of the future model of digital justice. Its two-dimensional impact - in access and in process - raises important questions in order to guarantee the principles and values at stake. This work of seminal nature, points out some problematic issues, identifies principles and values to preserve and advances the most important challenges that Spain must face in the coming years.
