The authenticity of communications intercepted under the european investigation order: SITEL versus other systems - Milagros López Gil

La necesidad de reforzar la cooperación judicial en materia penal en la Unión Europea ha llevado a la creación de la Orden Europea de Investigación. Este nuevo instrumento de cooperación jurídica pretende facilitar la investigación de los delitos con trascendencia transnacional, permitiendo la obtención de prueba en un país distinto de aquel en el que se ha incoado el proceso. No obstante, el hecho de que al amparo de la Orden Europea de Investigación se pueda adoptar la intervención de las telecomunicaciones para que sea llevada a cabo en otro Estado, a través de un sistema, normas y garantías desconocidas para nosotros, de la que van a resultar, además, unas grabaciones que pueden ser usadas como prueba en el plenario para desvirtuar la presunción de inocencia, genera múltiples problemas. En primer lugar, porque en la regulación de la Orden Europea de Investigación no está previsto cómo se van a llevar a cabo, y, en segundo lugar, porque una de las condiciones para reconocer efectividad a las grabaciones obtenidas es que las mismas se hayan realizado sin contradecir los principios fundamentales de nuestro ordenamiento jurídico, ni resultar contrarios a las garantías procesales reconocidas en nuestro país. Por tanto, es fundamental abordar el análisis del sistema de intervención de telecomunicaciones utilizado en nuestro país -SITEL- porque será a través de su análisis que podremos extraer aquellos requisitos que, tanto la doctrina como la jurisprudencia, han venido exigiendo para dotarlos de valor probatorio, constituyendo estos requisitos, el marco de referencia para las intervenciones de las comunicaciones obtenidas en otro Estado Miembro a través de sus propios sistemas.

The need to strengthen judicial cooperation in criminal matters in the European Union has led to the creation of the European Investigation Order. This new instrument of legal cooperation aims to facilitate the investigation of crimes with transnational significance, allowing the obtaining of evidence in a country other than the one in which the process has been initiated. However, the fact that under the European Investigation Order the intervention of telecommunications can be adopted to be carried out in another State, through a system, norms and guarantees unknown to us, of which they go to result, in addition, some recordings that can be used as evidence in the plenary to disprove the presumption of innocence, generates multiple problems. In the first place, because the regulation of the European Investigation Order does not provide for how they will be carried out, and, secondly, because one of the conditions to recognize the effectiveness of the recordings obtained is that they have been made. without contradicting the fundamental principles of our legal system, nor are they contrary to the recognized procedural guarantees. Therefore, it is essential to address the analysis of the telecommunications intervention system used in our country -SITEL- because it will be through its analysis that we can extract those requirements that, both doctrine and jurisprudence, have been demanding to provide them of probative value, constituting these requirements, the frame of reference for the interventions of the communications obtained in another Member State through its own systems.
