Elementos distorsionadores del nexo causal en la responsabilidad patrimonial de la Administración local respecto a los festejos populares. (RI §423436)
Para entender la relevancia de la responsabilidad patrimonial de las Administraciones Públicas es interesante acudir a los distintos ámbitos sectoriales que ayuden a delimitar cuáles son los elementos necesarios para su apreciación. Situándonos en la esfera local, la celebración de festejos populares es una fuente importante de situaciones que sirven para evaluar el correcto funcionamiento de los servicios públicos, más cuando en muchas de estas actividades hay un factor riesgo inherente. En estudio se podrá apreciar que no siempre la Administración actúa como una aseguradora universal de los ciudadanos, sino que la valoración del nexo causal torna en un elemento fundamental para determinar la trascendencia del deber de tutela que tiene ésta.
To understand the relevance of the patrimonial responsibility of the Public Administrations, it is interesting to go to specific cases that help to define what are the necessary elements for its assessment. Located in the local sphere, the celebration of popular festivals is an important source of situations that serve to evaluate the correct functioning of public services, especially when in many of these activities there is an inherent risk factor. In study we will be able to appreciate that the Administration does not always act as a universal insurer of citizens, but that the assessment of the causal link becomes a fundamental element to determine the importance of the guardianship duty that it has.
