El enfoque de la Unión Europea en el tratamiento extraterritorial de las solicitudes de asilo y el cumplimiento del derecho internacional - Piotr Sadowski

En 2018, la Comisión Europea esbozó tres escenarios de “plataformas regionales de desembarco”. Según la propuesta, los solicitantes de asilo que lleguen a la UE serían enviados a los estados del Norte de África a la espera de las correspondientes decisiones sobre asilo. Este trabajo mostrará que estos escenarios repiten los modelos de Australia y Estados Unidos. Debido a ello, se utilizará investigación previa para indicar que el concepto de la UE plantea preguntas sobre su conformidad con la Convención de Refugiados (que forma los cimientos del Sistema Europeo Común de Asilo) y la Convención Europea de Derechos Humanos de 1950. Se prestará especial atención a la legitimidad de un cambio previsto de jurisdicción de iure y de facto de la UE y sus Estados miembros a terceros países. La idea de plataformas fue reiterada en 2020 por Austria y Hungría durante las negociaciones de cambios en el sistema de asilo de la UE y es parcialmente visible en el Nuevo Pacto sobre Migración y Asilo. Por lo tanto, este análisis contribuye a discusiones más amplias sobre la legalidad de las verificaciones previas a la llegada de los solicitantes de asilo.

In 2018 the European Commission outlined three scenarios of “regional disembarkation platforms”. According to the proposal, asylum seekers arriving in the EU would be sent to the North African states to wait for asylum decisions. This paper will show that these scenarios repeat Australia’s and the U.S. models. Due to this previous research will be used to indicate that the EU’s concept raises questions regarding its conformity with the Refugee Convention (which forms the foundations of the Common European Asylum System) and the 1950 European Convention on Human Rights. Special attention will be paid to a legitimacy of an intended shift of jurisdiction de jure and de facto from the EU and its Member States to third countries. The idea of platforms was reiterated in 2020 by Austria and Hungary during negotiations of changes to the EU asylum system and is partially visible in the New Pact on Migration and Asylum. Hence, this analysis contributes to the wider discussions on the legality a pre-arrival verification of asylum seekers.
