Independent justice and parallel trials: social control of the jurisdictional function - Inmaculada López-Barajas Perea

La libertad de información y de opinión y el derecho a un juicio público forman parte de la estructura básica de un Estado democrático, pero no son derechos absolutos, sino que deben armonizarse con las garantías que integran el derecho a un juicio justo. Se analizan en este trabajo los efectos de los llamados “juicios paralelos”, tratando de determinar cuando pueden interferir en el curso de un proceso judicial pendiente. Para ello, resulta necesario distinguir entre una crítica a la pericia de un profesional en el ejercicio de su actividad y una lesión a su honor personal con el fin de crear una convicción social de culpabilidad y de influir en el órgano enjuiciador. En este último caso se produce un ataque a la “autoridad del Poder Judicial” que afecta directamente a la garantía de la imparcialidad como fuente de legitimación de la función jurisdiccional. Se presta especial atención a los derechos y garantías constitucionales afectadas y a los instrumentos procesales previstos y que debieran preverse, para contrarrestar los efectos de los “juicios paralelos”.

Freedom of information and opinion and the right to a public trial are part of the basic structure of a democratic State, but they are not absolute rights, but must be harmonized with the guarantees that make up the right to a fair trial. The effects of the so-called “parallel trials” are analyzed in this paper, trying to determine when they can interfere in the course of a pending judicial process. For this, it is necessary to distinguish between what constitutes a criticism of the expertise of a professional in the exercise of his activity and what constitutes an injury to his personal honor with the aim to create a social conviction of guilt and to influence the jurisdictional body. In the latter case, there is an attack on the “authority of the Judiciary” that directly affects the guarantee of impartiality as a source of legitimation of the jurisdictional function. Special attention is paid to the constitutional rights and guarantees affected by this and to the procedural instruments foreseen and that should be foreseen, to counteract the effects of the “parallel trials”.
