Del testamento ológrafo al testamento cibernético. (RI §423232)  


From the olographic testament to the cyber testament - Rosa Peñasco

La pandemia por coronavirus ha rescatado del olvido tanto el ancestral y peculiar testamento ológrafo, como la necesidad de que nuestro Ordenamiento deba contemplar un testamento electrónico, acorde con los tiempos que vivimos. Sin embargo, resulta curioso observar cómo el universo de las palabras y el mundo del Derecho se encuentran ampliamente relacionados entre sí, ya que la existencia del propio testamento ológrafo y hasta la admisión o no entre sus normas de un posible testamento electrónico, hoy en día parecen girar en torno a las acepciones de la palabra manuscrito que, etimológicamente y desde tiempo inmemorial, siempre ha significado “escrito a mano”. En lo que respecta a la esencia el testamento ológrafo, no hay duda de que guarda una relación directa con la palabra “manuscrito” pues en el proceso de adveración y protocolización de este testamento debe demostrarse que ha sido manuscrito por el testador. Sin embargo y desde no hace mucho tiempo, la palabra “manuscrito” no solo hace referencia al tradicional escrito a mano, sino que también significa “texto original de una publicación”. Esta nueva acepción de “manuscrito” puede acarrear grandes consecuencias en el universo del testamento, hasta el punto de abrir la puerta a que, junto al tradicional ológrafo y por muy increíble que parezca, pudiera permitirse un testamento electrónico al amparo de las normas de aquel. Y ello es así porque, si por medio de XML o con el conjunto de códigos que supone un lenguaje de marcado, se demostrara que el supuesto testamento es el texto original de una publicación la Jurisprudencia podría dar un giro radical e interpretar que, junto al tradicional escrito a mano, también es ológrafo el testamento electrónico, siempre que fuera escrito todo él mecánicamente por el testador y rubricado con su ya habitual firma digital.

The coronavirus pandemic has rescued from oblivion both the ancestral and peculiar holographic testament, as well as the need that our Order must contemplate an electronic will, in accordance with the times we live in. However, it is curious to observe how the universe of words and the world of Law are widely related to each other, since the existence of the holographic will itself and even the admission or not of a possible electronic will seem to revolve around the word manuscript that, etymologically and from time immemorial, has always meant "handwritten". There is no doubt that the essence of the holographic will bears a direct relationship with the word "manuscript" since in the process of adveration and protocolization of the will it must be shown that it has been handwritten by the testator. However, and not long ago, the word "manuscript" not only refers to a traditional handwriting, but also means "original text of a publication". This new meaning of "manuscript" can have great consequences in the universe of the will, to the point of opening the door to which, together with the traditional holograph, an electronic will could be allowed under the rules of the former. And this is so because if by means of XML or with the set of codes that a markup language supposes, it is demonstrated that the supposed testament is the original text of a publication, the Jurisprudence can take a radical turn and interpret that, together with the traditional Written by hand, the electronic will is also holographic, all of it written mechanically by the testator and initialed with his already usual digital signature.
