New dynamics in the European Union: proposal for creating funds conditioned to the commitment to the Rule of Law - Juan Francisco Barroso Márquez

En este artículo analizaremos el concepto de Estado de Derecho en la Unión Europea, los retos actuales que se presentan en varios de sus Estados miembros y los mecanismos con los que la Unión cuenta para garantizar en el Estado de Derecho. Tras ello, analizaremos la propuesta de la Comisión Europea para condicionar la recepción de los fondos de la Unión Europea al cumplimiento del Estado de Derecho en los Estados miembros, junto con los riesgos que conlleva esta vía, la postura de las distintas instituciones comunitarias y los detalles de su tramitación, para extraer conclusiones acerca de la adecuación o no de esta medida a las necesidades actuales de la Unión Europea.

In this article, we will analyse the concept of the Rule of Law within the European Union, the current challenges that are occurring in several of its Member States and the mechanisms that the EU has to protect the Rule of Law. After that, we will analyse the European Commission’s proposal to conditionate EU funds to the commitment to the Rule of Law in the Member States, along with the risks inherent to this method, the position of the European institutions and the details of its processing, to obtain conclusions referring to its suitability for the current necessities of the European Union.
