From the environmental state to the Anthropocene’s State: a fresh look at the hystory of environmental constitutionalism - Domenico Amirante

La necesidad de una transformación de la relación entre derecho y medio ambiente se basa en la constatación del carácter inadecuado del derecho moderno -y de sus estructuras conceptuales y normativas- para enfrentar y resolver los graves problemas ambientales planteados por un desarrollo económico sin limitaciones sustanciales. Esto implica la búsqueda de nuevos paradigmas económicos, políticos y jurídicos, basados en los conceptos de responsabilidad e interdependencia entre el ser humano y la naturaleza. En los últimos veinte años, el concepto de Antropoceno se ha extendido en muchos campos culturales, desde las ciencias duras a las ciencias sociales (sociología, antropología, economía, derecho), hasta llegar al arte, la literatura y al cine. En las últimas décadas, el constitucionalismo ambiental ha experimentado una expansión constante, lo que ha resultado en un aumento sustancial del número de constituciones democráticas que contienen principios y derechos ambientales (más de las tres cuartas partes de las constituciones del mundo). Teniendo en cuenta el panorama crítico antes mencionado, este artículo presenta el concepto de Antropoceno y expone un análisis comparativo, tanto desde una perspectiva diacrónica como sincrónica, sobre la evolución del derecho ambiental. El desarrollo del constitucionalismo ambiental muestra que en las primeras experiencias la protección del medio ambiente se limitó a disposiciones generales, instrumentales o meramente declamatorias. Por el contrario, la corriente actual del constitucionalismo ambiental (desde los años noventa) ilustra un enfoque diferente, basado en la centralidad de los valores ambientales en la estructura constitucional, logrando lo que se puede definir como una “revolución de los derechos ambientales”. A partir del entrelazamiento de estos temas, el artículo sugiere que es necesario plantear y promover un diálogo entre “diferentes” constitucionalismos medioambientales que van más allá de la mera relación caso/régimen jurídico, consagrando por vía jurídica el vínculo entre sociedad, historia, tradiciones indígenas y medio ambiente en el “Estado del Antropoceno”.

The need for a change in the connexion between law and the environment is based on the inadequacy of modern law -and legal conceptual and normative structures- to face and solve environmental issues. Thus, the search for new economic, political and legal paradigms based on the concepts of responsibility and interdependence between human beings and nature is essential. In the last twenty years, the concept of the Anthropocene spreads in many cultural fields, from hard to the social sciences (sociology, anthropology, economics, law), till arts, literature and movies. In recent decades, also environmental constitutionalism has been the object of a constant growth, increasing the number of democratic constitutions that contain environmental principles and rights. Taking into account the aforementioned critical background, this article introduces the concept of the Anthropocene through a comparative law lens, focusing on the evolution of environmental law–both from a diachronic and synchronic perspective. The development of environmental constitutionalism points out two specific: a) in the first experiences, the protection of the environment was limited to general, instrumental or merely declamatory provisions; b) the current environmental constitutionalism (since the 1990s) proves a different approach, based on the pivotal role of environmental values in constitutional orders, with the aim to achieve an “environmental rights revolution”. From the intertwining of these leading themes, the article suggests the need to aim and to foster a dialogue between “different” environmental constitutionalism(s) that go beyond the mere relationship between case/legal system, thus fostering the link between society, history, traditions, indigenous people, and the environment, tracing the path towards the “Anthropocene State”.
