The puzzle of civil cassation in spain or ordering the different Spains. Current and plural regulation of autonomic civil cassation. Lege data analysis and lege ferenda improvement proposals - Ixusko Ordeñana Gezuraga

Partiendo de que existen tantas casaciones autonómicas como derechos civiles autonómicos, analizamos las distintas ordenaciones de este recurso que existen en nuestro ordenamiento jurídico, distinguiendo aquéllas casaciones autonómicas que, sin contar con una ley propia de casación, se rigen por la ordenación de la casación común y las que cuentan con su propia ley. Proponemos un análisis objetivo de la materia, seguido de la enumeración y análisis de las críticas más importantes que se le hacen, para culminar con propuestas de mejora lege ferenda.

I. ¿CUÁNTAS ESPAÑAS DIFERENTES EXISTEN? O SOBRE LAS DIFERENTES CASACIONES AUTONÓMICAS Y SU RÉGIMEN JURÍDICO. I.1. Situación de partida y consiguientes necesidades de análisis I.2. Starting from the fact that there are as many autonomic cassation as autonomic civil laws exist, different regulations of this resource that concur in our legal system are studied, distinguishing those regional cassations that, without having a proper law of cassation, are governed by the regulation of common cassation from those that have their own law. We propose in order to culminate with lege ferenda proposals for improvement, an objective analysis of the subject, followed by the enumeration and analysis of the most important criticisms that are made.
