La (IN)constitucionalidad de la “intervención”, “mordaza” o “apagón” de las telecomunicaciones e internet por el gobierno en virtud del Real Decreto-Ley 14/2019. (RI §422488)  


The (in)constitutionality of the "intervention", " clamp" or "blackout" of telecommunications and the internet by the Government under Royal Decree Law 14/2019 - Lorenzo Cotino Hueso

Días antes de las elecciones el Gobierno aprobó el conflictivo Real Decreto-Ley 14/2019. Se analiza el mismo porque permite que el servicio público de telecomunicaciones se lleve a cabo por intervención y control gubernamental de los operadores de telecomunicaciones o por gestión directa. Se sostiene que ello puede implicar una poder total y variable de internet por el Gobierno. La norma sólo ha sido recurrida desde Cataluña, lo cual puede condicionar el análisis constitucional futuro por el TC y los tiempos en realizarlo. Se sostiene que la norma es inconstitucional pese a la necesidad de la defensa y seguridad nacional y seguridad y orden públicos. 1 Por la forma del Decreto-Ley. 2. Por no cumplir los mínimos estándares de calidad normativa. 3. Por no contar con las mínimas garantías del derecho de acceso a internet establecidas por el CEDH y las que deberían derivarse de la Constitución española. Se postula una pronta sentencia del TC o una reforma legislativa.

I. EL CONFLICTIVO REAL DECRETO LEY 14/2019 Y LOS PROFUNDOS CAMBIOS QUE IMPLICA. 1. Un conflictivo Decreto-Ley que sólo ha sido recurrido por Cataluña. 2. La mutación que implica la nueva regulación por su texto y su contexto. II. UNA ILIMITADA “INTERVENCIÓN”, “MORDAZA”, “APAGÓN” DE INTERNET POR EL GOBIERNO. 1. El ámbito de las telecomunicaciones donde opera la nueva legislación. 2. Las ilimitadas posibilidades de intervenir internet que parece facultar el nuevo artículo 4. 6º LGT. III. LA INCONSTITUCIONALIDAD POR TRATARSE DE UN DECRETO-LEY. 1. La posible inconstitucionalidad por la falta de la urgente y extraordinaria necesidad. 2. La inconstitucionalidad del Decreto-Ley por afectar derechos fundamentales. IV. LA PROTECCIÓN DE LA DEFENSA, SEGURIDAD Y ORDEN FLEXIBILIZA LAS GARANTÍAS, PERO NO LAS HACE DESAPARECER. V. LA INCONSTITUCIONALIDAD POR NO RESPETAR LAS MÍNIMAS GARANTÍAS PARA EL APAGADO DE INTERNET. 1. Una palmaria falta de calidad normativa. 2. Las insuficientes garantías exigibles para la desconexión o bloqueo de internet. VI. A LA ESPERA DE UNA SENTENCIA DEL TC O DE LA REFORMA DE LA LEY. VII. LA CUESTIONABLE CONSTITUCIONALIDAD DE LAS MEDIDAS CAUTELARÍSIMAS DE CESE DE ACTIVIDAD O PRESTACIÓN DE SERVICIOS.

Days before the elections, the Government approved the conflictive Royal Decree-Law 14/2019. It is analyzed because it allows the government intervention and control of the telecommunication operators or the direct management of the service and networks. It is stated that it grants total and variable power of the Internet by the Government. The norm has only been appealed from Catalonia, this may condition the future constitutional analysis and the timing by the Constitutional Court. The author considers that the norm is unconstitutional, despite the need to protect national security and public safety and order: 1 Because the form of Decree-Law. 2. For not complying with the minimum standards of normative quality. 3. For not having the minimum guarantees of the right of access to internet established by the ECHR and those that should derive from the Spanish Constitution. It is concluded that there is a need for a quick sentence by the CC or a legislative reform.
