El tráfico ilícito de libros y documentos que fueron sustraídos del Seminario de Cuenca y de la Biblioteca de la Catedral Conquense suscita la cuestión de cuál es el régimen de protección de bienes robados a instituciones eclesiásticas con especial referencia a las posibilidades de reivindicación de unos bienes que han entrado en le mercado del arte y respecto de los cuales existe en el ordenamiento jurídico español una normativa específica. La reciente sentencia del Tribunal Supremo 301/2019, de 28 de abril, tiene el valor de referirse directamente a este tema desde la perspectiva del derecho nacional. El objetivo de nuestro trabajo es indagar las posibilidades de adquirir a non domino en subasta pública bienes de la Iglesia poniendo de relieve la colisión de intereses entre el propietario original del bien sustraído ilícitamente y la protección del eventual adquirente de buena fe que ha comprado los bienes desconociendo su origen delictivo. El régimen especial resultante del art. 28 y de la Disposición Transitoria 5ª de la Ley de Patrimonio Histórico Español serán determinantes para resolver este asunto.

The illicit traffic of books and documents that were stolen from the Seminary of Cuenca and the Library of the Conquense Cathedral raises the question of what is the regime of protection of stolen goods to ecclesiastical institutions with special attention to the possibilities of claiming some goods that have entered the art market and for which there is a specific regulation in the Spanish legal system. The recent ruling of the Supreme Court 301/2019, dated April 28, has the courage to refer directly to this issue from the perspective of national law. The objective of our work is to investigate the possibilities of acquiring a non-domino in public auction in the Church property highlighting the collision of interests between the original owner of the stolen property and the protection of the eventual acquirer in good faith that has purchased the goods ignoring their criminal origin. The special regime resulting from art. 28 and of the 5th Transitory Provision of the Spanish Historical Heritage Law will be decisive for resolving this matter.
