Judicial collective redress and the new models of legal services in Spain - Manuel Ortells Ramos

El artículo 11 y concordantes de LEC regulan tanto la tutela judicial de intereses colectivos cuanto la petición colectiva de tutela de derechos individuales lesionados por una causa común. La regulación del segundo aspecto no ha sido suficientemente eficaz. Un sector de la abogacía española ha desarrollado un modelo de prestación de sus servicios que, mediante la publicidad y las actuales tecnologías de la información y la comunicación, está atendiendo las necesidades descuidadas por la regulación de LEC. Este modelo permitiría superar el principal obstáculo práctico para utilizar la acumulación objetivo-subjetiva de acciones como técnica para tratar eficientemente la litigiosidad masiva. No obstante, hay razones que no incentivan que los abogados opten por la acumulación.

I. LOS SIGNIFICADOS DE ACCIÓN JUDICIAL COLECTIVA/TUTELA JUDICIAL COLECTIVA Y LAS INSEGURIDADES DEL RÉGIMEN DE LOS ARTS. 11 Y CONCORDANTES DE LEC. 1. Brevemente sobre el régimen de los arts. 11 y concordantes LEC y las expectativas en la superabundante literatura jurídica sobre el mismo. 2. Las inseguridades del régimen de los arts. 11 y concordantes LEC y la moderación de las expectativas sobre su utilidad. II. CAMBIOS EN EL MODELO DE PRESTACIÓN DE SERVICIOS DE DEFENSA JURÍDICA Y SU RELACIÓN CON EL FENÓMENO DE LOS LITIGIOS EN MASA. 1. Breve excursus sobre la actitud de la abogacía USA ante las dificultades, o la inexistencia, de un régimen de class actions y su incipiente reflejo en la perspectiva empresarial de la abogacía en España. 2. Publicidad de los servicios de defensa jurídica y facilitación tecnológica de la comunicación con los eventuales demandantes de los mismos: Algunas muestras. III. LOS NUEVOS MODELOS DE PRESTACIÓN DE LOS SERVICIOS DE DEFENSA JURÍDICA Y LA ACUMULACIÓN INICIAL DE PRETENSIONES COMO ALTERNATIVA AL RÉGIMEN DE LEC SOBRE PETICIÓN COLECTIVA DE TUTELAS JUDICIALES INDIVIDUALES CONEXAS. 1. Dificultades para la acumulación derivadas de los presupuestos para su admisión y de la desatención normativa a los problemas de gestión originados por el elevado número de pretensiones acumuladas. 2. Una advertencia sobre esta alternativa: los posibles motivos que influyen sobre la decisión de acumular y la protección de los intereses públicos respecto del tratamiento de los litigios masivos.

Article 11 and concordant ones of LEC regulate both the judicial protection of collective interests and the collective claim for protection of a plurality of individual rights damaged by a common cause. The regulation of the second aspect has not been sufficiently effective. A sector of the Spanish bar has developed a model for the provision of its services that, through advertising and the current information and communication technologies, is addressing the needs neglected by the LEC rules. This model would overcome the main practical obstacle to using the joinder of parties as a technique to efficiently deal with mass litigation. However, there are reasons that do not encourage lawyers to opt for that technique.

I. THE MEANINGS OF COLLECTIVE ACTION/COLLECTIVE JUDICIAL PROTECTION AND THE UNCERTAINTIES OF THE SYSTEM OF ARTICLES 11 AND CONCORDANT ONES LEC (SPANISH CIVIL PROCEDURE LAW). 1. Briefly about the system of articles 11 and concordant ones LEC and the expectation raised about it by an overabundant legal literature. 2. Uncertainties of the system of articles 11 and concordant ones LEC and the restrain of the expectation about its utility. II. CHANGES OF THE MODEL OF LEGAL SERVICES AND THEIR RELATIONSHIP TO MASS LITIGATION. 1. Brief excursus about the USA bar attitude in case of lack, or difficulty, of a class action system and its emerging reflection in the entrepreneurial view of the Spanish bar. 2. Advertising of legal services and technological easiness for communication between legal firms and its possible clients. Some samples. III. NEW MODELS OF LEGAL SERVICES AND THE JOINDER OF PARTIES AS AN ALTERNATIVE TO THE LEC SYSTEM OF COLLECTIVE CLAIM FOR JUDICIAL PROTECTION OF A CONNECTED PLURALITY OF DAMMAGED RIGHTS. 1. Difficulties arising from the legal requirements for joinder of parties and from unsolved problems of case management in case of a high number of aggregated claims. 2. Some warnings about this alternative: possible reasons influencing the decision to use the joinder of parties technique and the protection of public interest in the treatment of mass litigation.
