Patto costituente e referendum consultivo regionale nell’ordinamento italiano. (RI §421338)  


Constituent pact and regional advisory referendum in Italy - Silvio Troilo

L’articolo analizza lo spazio del referendum consultivo, a livello regionale, in Italia. Tale istituto non è previsto dalla Costituzione (che disciplina, invece, due tipi di referendum deliberativo a livello statale), bensì dagli statuti e dalle leggi statutarie di tutte le Regioni italiane. Talvolta, in particolare in Veneto, si è tentato di utilizzare tale strumento di partecipazione anche per sollecitare il parere, non vincolante, della popolazione su aspetti fissati dal patto costituente e consacrati nella Costituzione. Al riguardo la Corte costituzionale ha precisato che, <>, dichiarando inammissibili anche iniziative delle popolazioni regionali di mero stimolo agli organi rappresentativi delle Regioni, che, per Costituzione vigente, hanno il potere di presentare proposte di revisione costituzionale. Resta, comunque, fermo che non possono mai essere modificati i principi supremi della Costituzione, tra i quali vi è l’unità e indivisibilità della Repubblica (art. 5 Cost.), fondata sull’esistenza di un unico popolo, quello italiano: per questo motivo il tentativo del Veneto di indire un referendum consultivo sulla indipendenza della Regione era illegittimo ed <>. Diversamente, è ammissibile un referendum consultivo regionale in merito all’attivazione o meno della procedura di attribuzione ad una Regione della più ampia autonomia di cui all’art. 116, terzo comma, della Costituzione, incidendo non sulle scelte del patto costituente ma sulla loro attuazione.

This article examines the space of the advisory referendum, at the regional level, in Italy. This instrument is not provided for by the Constitution (which regulates, instead, two types of deliberative referendum at the state level), but by the statutes and statutory laws of all Italian regions. Sometimes, in particular in Veneto, it has been attempted to use this instrument of participation also to solicit the non-binding opinion of the population on aspects established by the constitutional pact and included in the Constitution. The Constitutional Court has specified that, “as for the regional advisory referendums, they are necessarily set limits, just to avoid the risk of negatively affecting the constitutional and political order of the state”, declaring ineligible even merely stimulating initiatives of regional populations to the representative bodies of the Regions, which, by current Constitution, have the power to present proposals for constitutional amendment. It remains, however, firm that the supreme principles of the Constitution can never be changed, among which there is the unity and indivisibility of the Republic (Article 5 of the Constitution), based on the existence of a single people, the Italian one: for this reason the Veneto’s attempt to hold an advisory referendum on the independence of the Region was illegitimate and “extra ordinem”. Otherwise, a regional advisory referendum is admissible with regard to the activation, or not, of the procedure to give a region the broader autonomy referred to in Article 116, third paragraph, of the Constitution, not affecting the choices of the constitutional pact but their implementation.
