El control Judicial del referéndum legislativo - Bruna Žuber

La revisión judicial del referéndum legislativo es una denominación común para todas las formas de revisión jurisdiccional llevadas a cabo por los tribunales, organismos constitucionales u otros que sean competentes en cada país para el control de la constitucionalidad y legalidad de las regulaciones, procedimientos y decisiones en relación con el Instituto del referéndum legislativo. La autora analiza las últimas tendencias en la judicialización de los referendos y discute algunas preguntas abiertas sobre el control juducial del referéndum legislativo; es decir, la necesidad, dimensiones, alcance y contenido del control judicial del referéndum legislativo. El trabajo, a través de un enfoque comparativo, ofrece una visión completa de los mecanismos y garantías de los votantes en diferentes tipos de referéndum de revisión judicial. Además, parte del análisis se centra en la regulación y la práctica eslovenas de la revisión judicial del referéndum legislativo.

udicial review of the legislative referendum is a collective denomination for all forms of legal review carried out by the constitutional or other courts or bodies that are competent in each country for the review of the constitutionality and legality of regulations, procedures and decisions in connection with the institute of the legislative referendum. The author analyses the latest trends on the judicialization of referendums and discusses some open questions on judicial review of the legislative referendum; i.e. the need, dimensions, scope and content of judicial review of the legislative referendum. The paper through a comparative approach offers a more complete view on the mechanisms and guarantees of the voters within different types of referendum judicial review. In addition, part of the analyses focuses on the Slovenian regulation and practice of judicial review of the legislative referendum.
