The social rights of citizens of the European Union and the United Kingdom. Free circulation of workers and Social Security after the Brexit - Rocío Gallego Losada

Este artículo analiza el impacto de la salida del Reino Unido de la Unión Europea (Brexit) en los derechos sociales de los ciudadanos europeos. En concreto, se exponen las consecuencias que tendrá la aplicación del mecanismo de retirada previsto en el artículo 50 del Tratado de la Unión Europea sobre la libre circulación de trabajadores y la coordinación de los sistemas de Seguridad Social, incluyendo el ámbito de las pensiones públicas y privadas y el ámbito sanitario. Aunque el análisis se realiza comparando la situación de los ciudadanos británicos y los del resto de la Unión, el artículo presta un especial interés al caso español, debido al fuerte impacto que tiene el Brexit en España y en sus ciudadanos. Asimismo, el artículo explica las distintas opciones de relación futura entre la Unión Europea y el Reino Unido agrupándolas en las opciones más cercanas a un Brexit sin acuerdo y las opciones relacionadas con un Brexit blando, pero con un alto grado de cooperación. Esto último es relevante no sólo para el caso del Reino Unido, sino que también puede servir de referencia por si en el futuro algún otro país comunitario decide salir de la Unión Europea.

This article analyzes the impact of the departure of the United Kingdom from the European Union (Brexit) on the social rights of European citizens. In particular, the consequences of the application of the withdrawal mechanism provided for Article 50 of the Treaty on European Union on the free movement of workers and the coordination of Social Security systems, including public and private pensions and the health system. Although the analysis is made comparing the situation of British citizens and those of the rest of the European Union, the article pays special attention to the Spanish case, due to the strong impact that Brexit has in Spain and its citizens on Spanish soil. In addition, the article explains the different options for future relationship by grouping them into the options closest to a Brexit without agreement and the options related to a soft Brexit, but with a high degree of cooperation. The latter is relevant not only for the case of the United Kingdom, but can also serve as a reference in case some other country decides to leave the European Union in the future.
