Minor contracts. limitations imposed on the Public Sector Contracts Law of november 8, 2017 - Cristina Clementina Arenas Alegría

La Ley de Contratos del Sector Público, de 8 de noviembre de 2017 por la que se adaptan al ordenamiento jurídico español las Directivas 2014 cuenta entre sus objetivos con la lucha contra la corrupción. En un alto porcentaje, el uso de la contratación menor, y su apariencia de legalidad, constituye una vía habitual que se utiliza para incumplir los preceptos legales correspondientes sobre publicidad y concurrencia. Por ello la, Ley impone en el artículo 118 importantes limitaciones al uso de este tipo de contratos, limitaciones que han de interpretarse correctamente para que no supongan una eliminación en la práctica de esta figura.

The Public Sector Contracts Law, dated November 8, 2017 by which the 2014 Directives are adapted to the Spanish legal system includes, among its objectives, the fight against corruption. In a high percentage, the use of minor contracting, and its appearance of legality, constitutes a habitual way used to breach the corresponding legal precepts on publicity and concurrence. Therefore, the Law, in Article 118, imposes important limitations to the use of this type of contracts, limitations that must be correctly interpreted so that they do not suppose an elimination of this figure in practice.
