The limits of EU citizenship as catalyser of fundamental rights: the Court of Justice’s Judgment in the Coman case - Daniel Toda Castán

La sentencia del Tribunal de Justicia en el caso Coman ha aclarado la aplicabilidad a los cónyuges del mismo sexo de la jurisprudencia relativa al derecho derivado de los familiares de ciudadanos de la Unión a trasladarse y residir con ellos en su Estado Miembro de origen. El comentario estudia las cuestiones no resueltas por la sentencia Coman, las opciones que plantea a los Estados Miembros y la relación entre identidad nacional y matrimonio entre personas del mismo sexo. La sentencia supone un importante paso adelante para las parejas afectadas, pero pone también de manifiesto las limitaciones de la integración europea a a la hora de extender el disfrute de los derechos fundamentales.

The judgment of the Court of Justice in the Coman case has declared the applicability to same-sex spouses of the case law on the derived right for family members of Union citizens to move to and reside with them in their EU-Member State of origin. This case note studies the questions that the judgment leaves unresolved, the options with which it confronts Member States and the relationship between national identity and same-sex marriage. The judgment represents an important step forward for the couples concerned while at the same time revealing the limits of European integration as a catalyser of wider enjoyment of fundamental rights.
