Aunque la ratio decidendi, que sirve de fundamento normativo a la sentencia, exige que la resolución se atenga “al sistema de fuentes establecido” (Código Civil, 1.7), resulta que tal sistema es, por sí mismo, imperfecto debido a su carácter incoherente, incompleto e inconcreto. Estos defectos del sistema normativo permiten al operador jurídico, en este caso al Tribunal Supremo, un margen de libertad y creatividad en la selección, depuración y, en particular, en su interpretación ulterior que propicia la faceta dispositiva de creación judicial.

Although the ratio decidendi, which serves as the normative basis for the judgment, requires that the decision be "in accordance with the established system of sources" (Civil Code, 1.7), it appears that such a system is in itself imperfect due to its incoherent, incomplete and abstract nature. These defects of the normative system allow the legal operator -the Supreme Court- a margin of freedom and creativity in the selection, purification and, in particular, in Law’s later interpretation, which favors the operative side of Law’s judicial creation, either as a derivation of the normative sources applicable to the case, either as original normative creation when there is no normative source similar to the one from which to derive the rule applicavle to the case.
