Los derechos de los pacientes en la protección social de la salud: transformación digital de la sanidad. (RI §420059)  


Patient rights in the social protection of health: health’s digital transformation - Carmen Alemán Bracho y, Pilar Munuera Gómez

Este artículo analiza la protección social del derecho a la salud en relación a los derechos humanos fundamentales que toda persona tiene en la actualidad, relacionando este reconocimiento con los derechos de los pacientes en la actual transformación digital de la sanidad. La transformación digital de la sanidad mantiene el respeto a las necesidades que tiene toda persona para alcanzar su pleno desarrollo (Bondia García, 2013) y en especial en momentos de vulnerabilidad física y social que se producen en una persona enferma. La satisfacción de este derecho supone el reconocimiento a una serie de derechos sociales relacionados (derecho a la alimentación, protección medioambiental, etc.), que deben estar garantizados por parte del Estado. La protección de este derecho fundamental permite a la persona alcanzar su estabilidad física, social y económica en un sistema sanitario digital. La protección social de la salud ha estado dirigida desde sus orígenes a los menos favorecidos, alcanzando la consideración de un derecho fundamental dentro de la Declaración Universal de los Derechos Humanos (1948). A partir de este documento, se responsabiliza a las instituciones y al Estado, para que actúen positivamente en la creación de las condiciones necesarias para lograr estos derechos (Abreu y Abreu, 2009). Los Estados deben velar por el derecho a la protección a la salud, su acceso y los derechos de los pacientes, con el fin de generar las condiciones que permitan el adecuado desarrollo de sus ciudadanos en todas las etapas de su vida y en todas sus circunstancias.

This article analyzes the social protection of the right to health in relation to the fundamental human rights that every person has today, linking this recognition to the rights of patients in the current digital transformation of health. The digital transformation of healthcare maintains respect for the needs of every person to achieve their full development (Bondia García, 2013) and especially in times of physical and social failures that occur in a sick person. The satisfaction of this right implies the recognition of a series of related social rights, the right to food, the environment, etc. The protection of this fundamental right allows the human person to access physical, social and economic physics in a digital healthcare system. The social protection of health is directed from its origins to the less favored, reaching the consideration of a fundamental right within the Universal Declaration of Human Rights (1948). From this document, the institutions and the State are held responsible for acting positively in creating the necessary conditions for these rights (Abreu and Abreu, 2009). States must ensure the right to protection of health, access and the rights of patients, in order to generate the conditions that allow the proper development of citizens at all stages of their lives and in all their circumstances.
