Thibaut and Savigny. Translation of Thibaut's article: "About the calls historical school and nos historical school" - Javier de los Mozos

La Escuela Histórica de Savigny y sus discípulos, en el clima intelectual del historicismo de principios del siglo XIX y de la reacción contra el programa de política jurídica de la Ilustración, defendió una concepción del derecho vinculado a la tradición, que identificó en el derecho justinianeo el punto de partida de una ciencia jurídica adecuada para Alemania. Esto significó el desatender el derecho de la práctica, basado en un conjunto de fuentes más amplio. Thibaut, cuya propuesta de codificación del derecho civil para Alemania en 1814, había sido rechazada por Savigny, por las razones indicadas, escribe en 1838 en la revista por él fundada veintiún años atrás un artículo en el que se queja de que se llame escuela no histórica a los que no siguen la orientación de Savigny, como si para ellos no tuviera importancia la historia; de la vanidad y soberbia de los secuaces de la Escuela Histórica; de su falta de atención al derecho de la práctica y del fracaso de una formación académica para los jóvenes juristas que no les preparaba para la vida real. The Historical School of Savigny and his disciples defended, within the intellectual atmosphere of the historicism in the outset of the 19th. Century, and of reaction against the enlightened program of legal policy, an idea of law related to tradition, whereby Justinian’s law was identified as the starting point of a legal science adequate to Germany. As a consequence, the law in force, with its complex system of sources, was neglected by this line of legal studies. Thibaut, whose proposal in 1814 of codification for Germany had been rejected by Savigny, for the mentioned reasons, wrote in 1838 a paper in the journal founded by him twenty-one years before, in which he complains that the jurists who do not follow the Historical School are called the followers of the non-historical school, as if they were not concerned with history, denouncing the vanity and the arrogance of the followers of the Historical School; their neglect of the real law and the failure of legal education in the university for the young lawyers, who were graduated without the required preparation for practical life. We present the Spanish translation of that article.
