The uncertain future of european administrative law - Ángel Ballesteros Moffa

La consolidación del Derecho administrativo europeo aparece vinculado a la asunción europea de las categorías de Administración, acto y procedimiento administrativos. Así como a la europeización también procedimental de los ordenamientos internos, en cuanto a la faceta indirecta de aplicación administrativa del Derecho europeo como regla general. Pero esta construcción jurídica descansa en las <> de la voluntad política, donde fuerzas contrapuestas llevan tanto a avances en la integración como a fracasos incluso identitarios. En este contexto, para saber el rumbo de la ciencia administrativa europea y, en particular, hasta qué punto va a mantenerse la tendencia favorable a los intereses europeos: la aplicación del Derecho comunitario desde Europa o según Europa, no resulta baladí contemplar –separada y conjuntamente– este modelo aplicativo a través de la <> de los nuevos tiempos: cómo se están resolviendo y a qué precio los desafíos globales. De ahí que el estudio transite por la historia reciente e inminente de la realidad europea, desde el Tratado de Lisboa y su enmienda parcial al fallido Tratado Constitucional, hasta la crisis migratoria y el proceso del brexit, pasando por la adhesión de Croacia o la respuesta común a la crisis económica y fragmentación del sector financiero.

European administrative law has become consolidated through the European categories of administration, administrative act and procedure, and the procedural europeanisation of national laws, which implement administratively European law in general. But this legal construction depends on the shifting political will, whose opposing forces are leading to progress on Europena Union integration and the identity crisis. In this context, to know the future of European administrative law and, in particular, if the trend observed in favour of European interests will continued: the implementation of European law from Europe or according to Europe, it is appropriate to observe –separately and together– this model implementation through the new times: how are global challenges being addressed and at what price. Therefore, the study analyzes on this basis the actual and imminent history of European reality: the Treaty of Lisbon replacing the failed Constitutional Treaty, the Croatia’s accession to the European Union, the common response to the economic crisis and fragmentation in the financial sector, the migration crisis, and the brexit process.
