The different coloniaria condicio of originarii and adscripticii in the later roman empire - M.ª Luisa López Huguet

En el presente trabajo analizamos a través del estudio histórico-crítico de las fuentes y del examen de las aportaciones doctrinales precedentes la diferente situación jurídica, administrativa y fiscal de los colonos originarii y de los adscripticii. A mitad del siglo IV los coloni originarii son vinculados perpetua y hereditariamente al suelo cultivado, favoreciendo que la cuantía de la capitación se calcule en proporción a las unidades de tierra y la responsabilidad fiscal se traslade a su propietario. A partir del siglo V, en la parte Occidental, el ligamen al suelo queda sujeto a las reglas liberatorias de la prescripción. En la parte Oriental, comienza a configurarse la condición adscripticia que ultima Justiniano, estableciendo su carácter hereditario, imprescriptible, su incapacidad patrimonial, una severa regulación matrimonial y estrictos requisitos para decretar la validez contractual de la vinculación como adscripticius de una persona libre.

In the present work we analyze through the historical-critical study of the sources and the examination of previous doctrinal contributions the different legal, administrative and fiscal situation of the originarii coloni and of the adscripticii. In the middle decades of the IV century the originarii coloni are tied perpetually and hereditarily to the cultivated land, contributing to a change in the tax system, under which the taxable amount of the capitation is stablished increasingly in proportion to the units of land and the fiscal responsibility is moved to its owner. From the V century, in the West, the land tying is subject to the discharge rules of prescription. In the Eastern Part the adscripticia condicio begins and Justinian completes its regulation, establishing its hereditary and indefeasible character, its financial inability, a rigid marital regulation and strict requirements to declare the validity of the contract which links a free person to another as adscripticius.
