El delito de defraudaciones del fluido y análogas no ha merecido nunca demasiada atención por parte de la doctrina. Tampoco la jurisprudencia sobre el mismo ha cambiado demasiado en los últimos años. Dos factores, sin embargo, justifican la realización de un nuevo análisis crítico de carácter político-criminal y dogmático: en primer lugar, la llamada «crisis económica» que ha traído consigo la nueva reformulación del capitalismo neoconservador ha provocado la irrupción con fuerza del fenómeno de la pobreza energética en las antiguas sociedades del bienestar de corte socialdemócrata, lo que afecta de pleno a las energías y fluidos (electricidad, agua, gas…) que son el objeto material del delito castigado en el art. 255 CP y cuyo acceso garantizado constituye una de las condiciones materiales necesarias para el ejercicio de la libertad en condiciones igualdad; y en segundo lugar, los avances tecnológicos que han tenido lugar en el ámbito del uso de los equipos de telecomunicación justifican un replanteamiento de la interpretación de algunos aspectos del delito castigado en el art. 256 CP, sobre todo en sede de imputación objetiva.

The crimes of electricity theft and the like have not been particularly studied from the doctrinal point of view. Neither the case law regarding this crimes has developed significant changes during the last years. However, there are two elements which justify a new critical analysis, not only from the academic point of view, but also taking into account several reasons of criminal policy: firstly, the so-called “economic crisis”, which has supposed a reformulation of the neoconservative capitalism, being one of its strong consequences the phenomenon of the energetic poverty in the welfare societies of social-democratic inspiration. This context has a direct influence in the material protection (electricity, water, gas…) of the crime stated in art. 255 Criminal Code, and whose guaranteed access supposes one of the substantial conditions necessary to the free development of the person in a context of equality; and, secondly, the technological development in the use of the telecommunications justify to reconsider some matters of the art. 256 Criminal Code, especially from the objective perspective of the definition of crime.
