Freno al endeudamiento autonómico y coerción estatal en la Ley Orgánica de Estabilidad Presupuestaria y Sostenibilidad Financiera. (RI §418011)

La consagración del principio de estabilidad presupuestaria en los ordenamientos jurídicos europeos ha provocado un cambio en la distribución territorial del poder en el seno de los Estados miembro, especialmente en aquellos que cuentan con una forma de Estado descentralizada. Sin embargo, el modo en el que se han visto tensionados los principios e instituciones jurídico-constitucionales no ha sido uniforme en todos ellos. En algunos, como Alemania, el control estatal no ha cercenado la autonomía de los Länder. En España, en cambio, el balance de poderes entre el centro y los entes subcentrales se ha desequilibrado en mayor medida. Este trabajo tiene por objeto el estudio de la alteración que la traslación al ámbito interno de la regla de oro europea ha provocado sobre el derecho a la autonomía reconocido en los artículos 2 y 156 CE, atendiendo a la forma en que ha quedado vigilada e intervenida la autonomía financiera y política de las CCAA y el modo en que se han visto mermadas sus garantías debido al amplio elenco de medidas que la Ley Orgánica 2/2012, de 27 de abril, de Estabilidad Presupuestaria y Sostenibilidad Financiera atribuye al Gobierno de la Nación en caso de incumplimiento autonómico e, incluso, en situaciones de mero riesgo.

The consecration of the principle of budgetary stability in the European legal systems has caused a change in the territorial distribution of power within the Member States, especially in those decentralized. Nevertheless, the way in which the principles and constitutional institutions have been stressed, has not been uniform in all of them. In Germany, state control has not constrained the autonomy of the Länder. In Spain, however, the balance of power between central and sub-central entities has been further unbalanced. This paper aims to study how the translation of the European Golden Rule to the Spanish legal system has unleashed an alteration on the right to political and financial autonomy recognized in Articles 2 and 156 of the Spanish Constitution. To ensure the return to a balanced budget, the the Organic Law of Budgetary Stability and Financial Sustainability attributed to the central government a broad range of measures if both autonomic failure as mere risk situations.
