Mutaciones y tendencias. (RI §417706)

The unitary state: repeated formula territorial organization in Colombia. Mutations and trends - Liliana Estupiñan Achury

I. INTRODUCCIÓN.- II. SOBRE LA CONSTANTE HISTÓRICA DEL ESTADO UNITARIO.- III. LA CONSTITUCIÓN TERRITORIAL DE 1991. 1. Principios y tensiones 2. La tradicional división territorial 3. Otras divisiones territoriales.- IV. DESCENTRALIZACIÓN POR ASOCIATIVIDAD. LA NUEVA TENDENCIA.- V. CONSTANTE Y TRANSFORMACIÓN “LEVE” DEL ESTADO UNITARIO EN COLOMBIA. A MANERA DE CONCLUSIÓN.

Palabras clave: Colombia; constitución territorial; forma de Estado unitaria; descentralización; descentralización administrativa; autonomía; trasformación y asociatividad.;

This article analyzes the territorial organization of the Colombian State from its constitution which is encoded in the territorial unit model, with some mild lapses where a federal state was adopted. It will also take into account the French relevance in the territorial issue which is reflected, among other aspects, in the imitation of the “region” figure, still untold and the “departmental” figure. Of course, this is not the exact same concepts used in the French territorial state, but no doubt this has been a model state in terms of power distribution inside the territory, decentralization on “merely” administrative subjects, the frustrated regionalization, and the tendency towards the territorial associativity. In any case, the Colombian state, as it will be shown, is in the process of mutation and transformation, but, without drifting away from its constant territorial history: the unitary model.

I. INTRODUCTION.- II. ABOUT THE CONSTANT HISTORY OF THE UNITARY STATE.- III. THE TERRITORIAL CONSTITUTION OF 1991. 1. Principles and tensions 2. The traditional territorial division. 3.
