The budgetary stability and the fundamental economic rights after the crisis of 2008: a historical, economical and legal analysis - Luis Pires Jiménez

El objetivo de este artículo es establecer las relaciones entre el equilibrio presupuestario y los derechos económicos fundamentales. El análisis parte de la controversia existente sobre en qué medida las políticas económicas que se han desarrollado para hacer frente a la crisis financiera de 2008 han podido afectar a derechos económicos fundamentales. Para ello se analiza el papel del equilibrio presupuestario, tanto en la crisis como en las reformas legales y constitucionales, la más destacada la ocurrida en 2011 que introducía el equilibrio presupuestario en el artículo 135. Este análisis se completa con un estudio histórico de las crisis económicas en España y de las reformas legislativas que esas crisis propiciaron, utilizando un análisis histórico, económico y de derecho comparado. La principal conclusión del artículo es que el equilibrio presupuestario no pone en peligro los derechos económicos fundamentales, al contrario, los asegura, debido a las siguientes causas: el equilibrio presupuestario permite conseguir un crecimiento económico estable y duradero que es el principal garante de los derechos económicos fundamentales; la norma constitucional de equilibrio presupuestario es suficientemente flexible al permitir déficits cíclicos; y aunque se reduzca el presupuesto, no tiene por qué hacerse en las partidas que afectan a derechos económicos fundamentales, y si afecta a esas partidas, se pueden mantener las prestaciones de estos derechos si la reducción se basa en una optimización de los recursos.

The aim of this paper is to establish the relationship between the budgetary stability and the fundamental economic rights. The analysis starts with the controversy about the extent to which economic policies that have been developed to address the financial crisis of 2008 have affected fundamental economic rights. To this end the article analyses the role of balanced budgets in both the crisis and the legal and constitutional reforms, most prominently the reform which introduced in 2011 the budgetary stability in the Article 135. This analysis is completed by a historical study of the economic crises in Spain and the legislative reforms that led to these crises, using a historical, economical and legal analysis. The main conclusion of the paper is that the budgetary stability does not endanger the fundamental economic rights, on the contrary, it ensures them, due to the following causes: the budgetary stability lets achieve a stable and sustainable economic growth, which is the main guarantor of fundamental economic rights; the constitutional budgetary stability rule is sufficiently flexible to allow for cyclical deficits; and though the budget is reduced, does not have to be on items affecting fundamental economic rights, and whether it affects these rights, the performance of these duties can be maintained if the reduction is based on a resource optimization.
