Are social security rights under discussion in Spain? The impact of european standards in times of crisis. (RI §416314)  


¿Están cuestionados los Derechos de Seguridad Social en España? el impacto de los estándares europeos en el contexto de la crisis - Luis Jimena Quesada

El presente trabajo pretende presentar la evolución de los derechos de seguridad social y el modo en que los parámetros constitucionales se han visto influidos por medidas restrictivas adoptadas en el contexto de la crisis económica (recortes sociales mediante la reducción del déficit público, suspensión del incremento de las pensiones a través de ajustes presupuestarios, nuevos indicadores controvertidos como el denominado Factor de Sostenibilidad y del Índice de Revalorización del Sistema de Pensiones de la Seguridad Social, etc.). Desde esta perspectiva, el autor subraya el contrapeso de los estándares internacionales y europeos (especialmente, el principio de progresividad establecido en relación con los derechos de seguridad social en la Carta Social Europea y sus recientes desarrollos en la jurisprudencia del Comité Europeo de Derecho Sociales). En su opinión, la principal preocupación radica en que la crisis económica puede siempre ser superada mediante medidas financieras y económicas. Al contrario, la legislación anticrisis puede implicar un profundo retroceso para el acervo social ya conseguido y, por añadidura, puede significar una generación perdida e irrecuperable. Por tal razón, cuestiona la actual posición del Tribunal Constitucional español, que no ha sido sensible a los parámetros europeos que han analizado la legislación nacional anticrisis que ha afectado a derechos laborales y de seguridad social, en comparación con algunos órganos jurisdiccionales ordinarios (que han mostrado una voluntad jurisdiccional positiva al dar cumplimiento a esos parámetros europeos), incluso a través del denominado control de convencionalidad. A modo de conclusión, el autor pone el acento en que la sinergia entre los cánones nacionales e internacionales se revela esencial para preservar el acervo en el ámbito de los derechos de la seguridad social, lo cual implica que los poderes públicos españoles (tanto a nivel judicial como político) deben asumir un mayor compromiso a la hora de cumplir e incorporar los mandatos internacionales sobre seguridad social.

I. LOS DERECHOS DE SEGURIDAD SOCIAL EN ESPAÑA: EVOLUCIÓN CONSTITUCIONAL: 1. Breve referencia a la seguridad social con anterioridad a la vigente Constitución de 1978. 2. EL IMPACTO DE LAS DISPOSICIONES CONSTITUCIONALES SOBRE SEGURIDAD SOCIAL EN EL ESTABLECIMIENTO DEL ORDENAMIENTO INTERNO: 1.Incoporación de mandatos internacionales. 2. Configuración y articulación de disposiciones nacionales relativas al modelo de Seguridad Social.- III. ÁMBITO PERSONAL Y MATERIAL DE LOS DERECHOS DE SEGURIDAD SOCIAL GARANTIZADOS POR LA CONSTITUCIÓN ESPAÑOLA.- IV. GARANTÍAS CONSTITUCIONALES DE LOS DERECHOS DE SEGURIDAD SOCIAL: 1. La importante función desempeñada por el Tribunal Constitucional español. 2. La apertura a los parámetros internacionales relativos a la seguridad social.- V. EL FUTURO DE LOS DERECHOS DE SEGURIDAD SOCIAL EN EL ORDENAMIENTO ONSTITUCIONAL ESPAÑOL EN EL CONTEXTO DE LA CRISIS ECONÓMICA.

This essay intends to present the evolution of social security rights and how Constitutional standards have been influenced against the backdrop of this economic and financial crisis: social cutbacks as a consequence of the reduction of the public deficit, freeze of pensions as a result of budgetary tightening, new controversial indicators such as the so-called Sustainability Factor and the Revaluation Index in the Social Security Pensions System, etc. From this perspective, the author highlights the counter-weight of international and European standards (especially, the principle of progressiveness, which is set forth in relation to social security rights under the European Social Charter and its recent developments through the case-law of the European Committee of Social Rights). In his view, the main concern is that an economic crisis may always be overcome with financial and economic measures. By contrast, “anti-crisis” legislation may imply a profound setback for the social legal acquis and, in addition, may mean a lost and irrecoverable generation. For this reason, he discusses the current position of the Spanish Constitutional Court, which has not been sensitive to European standards on national “anti-crisis” legislation affecting labour and social security rights in comparison to several ordinary judges (which have shown a positive judicial will by implementing these European standards), including the exercise of the so-called control of conventionality. To conclude, the author emphasizes that the synergy between national and international standards is essential in order to keep the acquis in the field of social security rights, which implies that Spanish authorities (both at judicial and political levels) should be more committed to implementing and incorporating international social security standards.

THE FUTURE OF SOCIAL SECURITY RIGHTS UNDER THE SPANISH CONSTITUTIONAL STANDARDS IN TIMES OF ECONOMIC CRISIS.
