The spanish child protection legal reform: impact on chiildren’s rights - Julia Ramiro

El artículo discute el reciente proceso de reforma legislativa sobre protección a la infancia y la adolescencia en España, iniciada en 2011, que revisa los criterios de protección, el interés superior y establece un nuevo protocolo de intervención social y jurídica en materia de infancia garantista con los derechos de los niños. Para ello, se contextualiza social y políticamente la propuesta, señalando sus antecedentes e identificando los agentes que intervienen y dinamizan la reforma. Posteriormente, se analizan las principales modificaciones planteadas tanto por el Anteproyecto de ley Orgánica del Sistema de protección a la Infancia y a la Adolescencia, como por la regulación vigente. Se concluye con una valoración sobre el impacto de la reforma en el conjunto de derechos de los niños.

This article discusses the recent process of the Spanish child protection legal reform initiated in 2011. This reform thoroughly revises protection criteria, the best interest of the child and stablishes a new protocol of social and juridical intervention in childhood matters, which guarantees children’s rights. In order to do that, this proposal is social and political contextualized by identifying the main agents and interests that participate and promote the legal reform. Following, I analyse the 2011 Draft of Organic Child Protection law, as well as the current child’s regulation. It concludes with an assessment about the impact of the legal reform on the children’s rights.
