The transposition of directive 2013/48/Eu in regard to the right of access to a lawyer in criminal proceedings in the light of draft Organic Law amending the criminal procedure act - Pablo García Molina

Este trabajo aborda la transposición de la Directiva 2013/48/UE en lo que respecta al derecho a la asistencia de letrado en los procesos penales a la luz del Anteproyecto de Ley Orgánica de modificación de la Ley de Enjuiciamiento Criminal para la agilización de la justicia penal, el fortalecimiento de las garantías procesales y la regulación de las medidas de investigación tecnológicas que fue aprobado por el Consejo de Ministros el 5 de diciembre de 2014 y que, como señala su disposición final quinta, prevé incorporar al Derecho español esta Directiva modificando para ello los arts. 118, 520 y 527 LECrim.

This paper addresses the transposition of Directive 2013/48/EU in regard to the right of acces to a lawyer in criminal proceedings in the light of Draft Organic Law amending the Criminal Procedure Act for speeding up of criminal justice, strengthening procedural guarantees and regulation measures of technological research which was approved by the Cabinet on 5 December 2014 and, as its fifth final provision says, plans to incorporate into Spanish law this Directive by amendment to the arts. 118, 520 and 527 LECrim.
