Reforming social security schemes in Europe: the European Committee of Social Rights and the European Court of Human Rights facing potential retrogression in the enjoyment of the right to social security - Jordi Bonet Pérez

Los últimos episodios de crisis financiera y económica, así como las necesidades de redefinición de las políticas sociales, han hecho proliferar en los últimos años las reformas de los regímenes de Seguridad Social europeos. Estas reformas han supuesto muy especialmente la adopción de medidas regresivas en materia de seguridad social. Tanto el Comité Europeo de Derechos Sociales como el Tribunal Europeo de Derechos, desde su respectiva competencia, han debido abordar la evaluación de su conformidad con las normas jurídicas internacionales, respectivamente, en relación con el artículo 12 de la Carta Social Europea y en relación principalmente con el artículo 1 del Protocolo adicional primero al CEDH. Se han analizado las respectivas jurisprudencias para llegar a comprobar cómo de divergentes son las soluciones adoptadas y la excesiva extensión del margen de apreciación que el TEDH concede al analizar las restricciones relativas al derecho a la seguridad social como derecho patrimonial (aplicando la doctrina de la protección indirecta). Esta divergencia demanda que el CEDS sepa mantener una cierta autonomía interpretativa en estos casos frente al TEDH, a pesar de la tendencia a asumir los criterios interpretativos del TEDH en aras de la efectividad de los derechos humanos.

The recent episodes of financial and economic crisis, as well the need to redefine social policies, have led to a proliferation of reforms in European social security schemes. These reforms have led to retrogressive measures in social security. Both the European Committee of Social Rights (ESRC) and the European Court of Human Rights (ECHR), in their areas of competency, have had to consider how these reforms comply with international norms, respectively in relation to Article 12 of the European Social Charter and, mainly, Article 1 of the First Additional Protocol to the European Convention on Human Rights. Their respective case-law is analysed to understand how the different solutions that have been adopted diverge and to show the excessive widening of the margin of appreciation granted by the ECHR when assessing the restrictions relating to the right to social security as a property right (applying the doctrine of indirect protection). This divergence requires the ESRC to maintain a degree of autonomy with respect to the jurisprudence of the ECHR, despite the tendency to assume the interpretative criteria of the ECHR in the aim of guaranteeing the effectiveness of human rights.
