Constitutional theory and political activism. Theoric and practical problems related to social fundamental rights - Carlos Luis Strapazzoni y Rodrigo Goldsmichdt

O objeto principal deste texto é oferecer uma discussão crítica sobre o uso, na teoria do direito, do termo composto ativismo judicial. O ambiente institucional de análise deste trabalho é a democracia constitucional brasileira e seu completo sistema de direitos fundamentais e modelo misto de controle de constitucionalidade. A principal hipótese é que a teoria contemporânea da democracia e dos direitos fundamentais, em ambientes institucionais como o do Brasil, oferece soluções menos obscuras para explicar as novas e polêmicas formas de atuação judicial utilizadas para proteger direitos fundamentais a prestações positivas. Para isso, o artigo analisa os usos do termo ativismo judicial em todos os contextos conhecidos, e fundado na experiência jurisprudencial internacional e brasileira oferece críticas ao seu uso atual. O artigo também salienta, como alternativa menos obscura, a maneira pela qual as funções jurisdicionais atuais exercem um decisivo papel na estruturação da dimensão responsiva da democracia. A tese principal é que o empoderamento judicial atual, bem como as novas competências judiciais protetivas de direitos fundamentais a prestações positivas estão pouco, ou quase nada, relacionadas com ativismo judicial; e muito, ou quase plenamente, relacionadas com as legítimas funções jurisdicionais de controle dos direitos subjetivos gerados pela dimensão responsiva de democracias constitucionais como a do Brasil.

The main object of this paper is to offer a critical discussion of the use, in legal theory, of the compound term judicial activism. The institutional environment of this work is the brazilian constitutional democracy and its complete system of fundamental rights and mixed model of judicial review. The main hypothesis is that the contemporary theory of democracy and fundamental rights in institutional settings such as Brazil, offers solutions less obscure to explain the new and controversial forms of judicial action used to protect the fundamental rights of positive actions. For this, the article analyzes the uses of the term judicial activism at all familiar contexts, and based on the brazilian and international jurisprudence experience, it offers a critical approach to its current usage. The article also points out, as a less obscure alternative, the way the current judicial functions play a decisive role in structuring the responsive dimension of democracies. The main thesis is that the current judicial empowerment, as well as new judicial powers related to a more protective judicial control to enforcement of fundamental rights to a positive action are little, if anything, related to judicial activism, and much, or nearly fully, related to the legitimate judicial functions generated by the responsive dimension of the constitutional democracies like Brazil.
