El presente estudio se propone, como su subtítulo se encarga de resaltar, un análisis crítico de la reforma legislativa del ordenamiento laboral que el Gobierno del Partido Popular ha acometido en 2012, por considerarla imprescindible frente a la grave situación de la economía y del empleo generada por la crisis económica, en medio de los reclamos de organismos y mercados financieros. Tras un año de aplicación efectiva de las soluciones normativas adoptadas, puede sostenerse ya con fundamento que esta reforma no solo no ha contribuido a la creación de empleo, como era previsible de modo objetivo por lo demás (¿hacia la creación de empleo a través de la facilitación y el abaratamiento de los despidos?), sino que la ocupación y el empleo existentes antes de su entrada en vigor han caído de forma considerable y alarmante. La reforma laboral 2012 es, a fin cuentas, injusta por ideológica y desequilibrada en favor de uno de los intereses en juego, los empresariales.

I. La política legislativa del Gobierno del Partido Popular en materia de empleo, seguridad social y migraciones, un año después del inicio de la legislatura: balance nominativo y recordatorio político.- II. Hacia la creación de empleo a través de la facilitación y el abaratamiento de los despidos: una misión imposible en tiempos de crisis económica severa.- III. La Ley 3/2012, de 6 de julio, de medidas urgentes para la reforma del mercado laboral: una «reforma de envergadura» frente a la «gravedad de la situación económica y de empleo».- IV. Una operación legislativa de flexibilización profunda del modelo laboral: la «flexiguridad» como objetivo político de la reforma.- V. La reiteración del patrón normativo al uso y su secuencia legislativa doble: utilización del decreto-ley por razones de extraordinaria y urgente necesidad y su tramitación parlamentaria posterior como proyecto legislativo.- VI. Ausencia de concertación social y deslegitimación sindical de la reforma.- VII. Las «debilidades del modelo laboral»: desempleo y temporalidad.- VIII. La terapia prescrita y sus medidas de actuación: la creación de un «horizonte de seguridad jurídica y confianza» para la recuperación del empleo.- IX. Una valoración general de la reforma como conclusión.

This study proposes, as its subtitle highlights, a critical analysis of the legislative reform of labour law that the People's Party Government has undertaken in 2012 by considering essential facing to the plight of the economy and the employment generated by the economic crisis, amid claims of agencies and financial markets. After a year of effective implementation of the regulatory solutions adopted, with foundation, it can be argued that this labour market reform not only it has not helped to job creation, predictably objectively (¿toward the creation of employment opportunities through simplify and cheapen layoffs?), but the existing occupation and employment prior to their entry into force have fallen significantly and alarmingly. The 2012 labour reform is, after all, unfair by ideological and unbalanced in favour of one of the interests at stake, the entrepreneurs.

The legal policy of the Government of the People’s Party with regard to employment, social security and migration, one year after the beginning of the parliamentary term: nominative assessment and political reminder.- II. Towards creation of employment op-portunities through simplify and cheapen layoffs: an impossible mission in times of serious economic crisis.- III. Law 3/2012, of July 6, 2012, on urgent measures to reform the labour market: a “huge reform” against “the gravity of the economic situation and employment”.- IV. A legislative process to promote a deep flexibility of the labour model: ‘flexicurity’ as a political target of this reform.- V. The reiteration of the usual normative pattern and its dual legislative sequence: the use of the decree-law for extraordinary reasons and urgent necessity and sub-sequent parliamentary process as a bill.- VI. Absence of social agreement and the discredit of this reform from the trade union point of view.- VII. Weaknesses of labour model: unemployment and temporary employment.- VIII.
