El autor analiza un fragmento de las Quaestiones de Africano presente en D. 47.2.62 pr. en relación con el hurto que el servus communis lleva a cabo en perjuicio de uno de los condueños. El jurista propone la actio communi dividundo interpuesta por el copropietario hurtado contra el otro condueño, surgiendo la alternativa entre un damnum praestare o un partem cedere, que recuerda a la alternativa característica que se ofrecía al dueño del esclavo demandado con la actio furti noxalis. Sin embargo, una atenta lectura del fragmento permite rechazar la idea sostenida por algunos autores de una sustitución justinianea de una originaria referencia a la acción de hurto por la acción de división de la cosa común.
The author analyses one text from the African’s Quaestiones in D. 47.2.62.pr. regarding the theft which the servus communis has committed to the detriment of one of the joint owners. The jurist proposes the actio communi dividundo brought by the joint owner, which has suffered the theft against another joint owner, raising the alternative between a damnum praestare or a partem cedere, which recalls the typical alternative of the actio furti noxalis. Nevertheless, a careful reading of the fragment allows to reject the idea held by some scholars of the justinian replacement of the actio communi dividundo instead of a original actio furti.
