La inexcusable necesidad de articular integralmente la prevención de riesgos laborales en buques mercantes desde la realidad específica y extraterritorial del trabajo marítimo y el indispensable bienestar a bordo de la gente de mar. (RI §412281)

Es una evidencia que el sector marítimo es uno de los que registra mayores índices de siniestralidad. Obviamente, la prevención de riesgos laborales implica tratar el tema de la seguridad laboral como un aspecto más -pero con el suficiente grado de autonomía- del bienestar de los trabajadores del mar embarcados. Por ello mismo, en el mundo marítimo, la seguridad laboral debe abarcar necesariamente un amplio espectro de normas, que incluye toda la correspondiente a la seguridad de la navegación (también denominada seguridad de la vida humana en el mar) y también toda la correspondiente a la seguridad en el trabajo (también denominada seguridad y salud laboral a bordo), que debe tenerse en cuenta como un todo a la hora de establecer esquemas prevencionistas, sin pasar por alto que el bienestar a bordo de la gente de mar es un medio fundamental para lograr la seguridad marítima.

I. El buque como causa determinante de riesgos específicos de la realidad específicamente extraterritorial del trabajo marítimo, no contemplados en otros sectores económicos.- II. La innegable dimensión multidisciplinar de la seguridad marítima.- III. El efecto multiplicador del bienestar a bordo de la gente de mar sobre la seguridad marítima, frente a la rentabilidad empresarial, por reducción de costes laborales, como verdadero factor de riesgo para una navegación segura y no contaminante.

It is evidence that the maritime sector is one of which registers higher rates of accidents. Obviously, the prevention of occupational risks involves dealing with the subject of the safety at work like a question -but with the sufficient degree of autonomy- of the welfare of seafarers on board. Therefore, in the maritime world, the safety at work has to cover necessarily a broad spectrum of laws. That includes all the corresponding to the safety of navigation (also called safety of human life at sea) and also everything concerning safety at work (also called occupational safety and health on board), that must be taken into account as a whole in order to establish the prevention of occupational risks, without overlooking that the welfare of seafareres on board is fundamental to attain maritime safety.

I. The ship as the determining cause of specific risks of the particularly extraterritorial reality of maritime work, not covered by other economic sectors.- II. The undeniable multidisciplinary dimension of maritime safety.- III. The multiplier effect of the welfare of seafarers on board on maritime safety, against business profitability, by reducing labour costs, as a true risk factor for safe and non-polluting navigation.
