El presente comentario tiene por objeto analizar la interpretación que ha realizado recientemente el Tribunal Supremo sobre las consecuencias que tiene la falta de habilitación administrativa de un vigilante de seguridad, cuando la subrogación obligatoria viene impuesta por el convenio colectivo de aplicación, refiriéndose concretamente a lo dispuesto en el artículo 14 del convenio colectivo de empresas de seguridad.

This work analyses the interpretation that the Supreme Court has done about the consequences of the lack of administrative empowerment in workers who must be transferred to a new company as a result of the obligatory subrogation included in collective bargaining, referring specifically to the article 14 of the security companies’ collective agreement.
