La expresión iustus tutor, aparece recogida en muy pocas fuentes jurídicas: en las prejustinianeas, siete son los restos (documentales, papirológicos y epigráficos) que aluden a ella, presentando como denominador común sus coordenadas espacio-temporales, mientras que en las fuentes justinianeas, dos son los únicos fragmentos que aluden a esta expresión. Partiendo de la exégesis de todos estos textos observamos que el significante iustus referido al tutor dativo, tiene varios significados, entre los que proponemos el de ser un tutor honesto, bueno, y celador de los intereses de su pupilo como debe ser, al menos en época tardía, la tutela asistencial.
The term iustus tutor appears in very few legal sources: in the prejustinian, seven remnants (documentary, papyrological and epigraphic) allude to it, presenting their space-time coordinates as the common denominator, whereas in the Justinian’ sources only two fragments refer to this expression. Based on the exegesis of these texts we find that the signifier iustus referred to the dative guardianship has several meanings, among which we propose the one of being an honest and good tutor, and guard of the interests of his pupil, as should be, at least in the late epoch, the assisting tutelage.
