El objeto de la sentencia del Tribunal Supremo de 1 de marzo de 2011, que se somete al presente comentario es resolver el conflicto colectivo que se plantea de interpretación del convenio colectivo provincial en materia de jornada y calendario laboral, teniendo en cuenta las reglas legales sobre hermenéutica de las normas jurídicas, para determinar si la interpretación del Convenio colectivo provincial es correcta y se ajusta a Derecho, a lo que establece el propio convenio colectivo y a las reglas sobre la estructura de la negociación colectiva que fija el Estatuto de los Trabajadores.

The object of the judgment of the Supreme Court of March 1, 2011, which surrenders to the present comment is to solve the collective conflict that appears of interpretation of the collective provincial agreement as for day and labor calendar, having in it counts the legal rules on hermeneutics of the juridical procedure, to determine if the interpretation of the collective provincial Agreement is correct and adjusts to Law, to what establishes the own collective agreement and to the rules on the structure of the collective bargaining that fixes the Statute of the Workers.
