El Estatuto de Autonomía en la STC 31/2010. (RI §411052)

Una de las cuestiones más destacadas de la STC 31/2010 es la noción de Estatuto de Autonomía que asume el Tribunal Constitucional. En este trabajo se pasa revista a los contenidos legítimos, la posición en el ordenamiento y las funciones constitucionales del Estatuto en el Estado autonómico que ha asumido el Tribunal. Se analizan los elementos de continuidad y ruptura con la doctrina anterior del propio Tribunal, elaborada en dos fases sucesivas: hasta 2007, de forma fragmentaria, y en la STC 247/2007, de forma sistemática. También se analiza si la idea de Estatuto implícita en los autores del Estatuto catalán de 2006 y que se expresa en el texto aprobado se corresponde con la de los estatutos anteriores. La desvalorización constitucional del Estatuto que lleva a cabo el Tribunal es la respuesta a la pretensión de los estatuyentes de canalizar a través del Estatuto todas las demandas de autogobierno de Cataluña y todos los contenciosos jurídicos entre Cataluña y el resto de España.

One of the main issues included in the Constitutional Court’s judgment 31/2010 is the concept of Statute of Autonomy that is assumed by the Court. In this essay we study the possible contents, the position in the legal system and the constitutional functions of the Statute in the Autonomous State according to the Court. We analyze whether this judgment follows or changes the former doctrine, produced by the Court in two successive moments: until 2007, in fragmentary terms, and in the judgment 247/2007, in a systematic way. Furthermore we study if the notion of Statute applied by the authors of the 2006 Catalan Statute is the same that it does exist in the former statutes. The constitutional devaluation of the Statute made by the Constitutional Court is the answer to the Statute fathers’ intention to include in the Statute all Catalan self-government demands, and to convert the Statute in the legal instrument for solving every legal dispute among Catalonia and the rest of Spain.
